Sony PS3 Jailbreak Hacker Bankrupted, May End Up in Jail

Although Geohot was able to settle with Sony over the PS3 jailbreak, other hackers have not fared as well.

Graf_chokolo is a hacker who worked hard to bring linux back after Sony removed the install option from the PS3. He has run out of money to fight Sony's lawyers and may end up in jail as a result.

Hi guys, no money left anymore. Going to jail soon probably because i cannot pay court costs.

But i’m ready to stand up for everything i said and go to jail for that too. It’s not important to win, more important is to show them that we are ready to fight, that they cannot scare me off easily. Yeah, i’m ready to go to jail for my believes and my principles.

Most of people probably think that all computer and kernel hackers are weak kids, hiding in a cellar, eating pizza whole day, writing software and looking for attention :-) Maybe, but that’s NOT me. And i will get out eventually and continue my work. My work means very much to me.

Those looking to contribute to Graf's defense can do so here.

Sony Demands YouTube Reveal Personal Info From PS3 Jailbreak Video

Sony is demanding that YouTube surrender the personal information of those who viewed Geohot's PS3 jailbreak video on a private page, according to Wired.

The company is demanding that a federal judge order Google to surrender the IP addresses and other identifying information (.pdf) of those who have viewed or commented about the jailbreak video on a private YouTube page. The game maker is also demanding that Twitter provide the identities of a host of hackers who first unveiled a limited version of the hack in December. A hearing is tentatively set for Wednesday. Sony filed its documents about 7:30 p.m. PST on Friday.

In what has widely been described as an outrageous and frightening case, Sony has sued Geohot for jailbreaking the PS3. The Electronic Frontier Foundation notes that Sony claims it has rights in the computer it sells you even after you buy it, and therefore can decide whether your tinkering with that computer is legal or not. The U.S. Copyright Office has exempted cell phone jailbreaking from being covered by the DMCA; however, the PS3 and other gaming consoles have yet to be exempted.

Geohot has recently posted a Motion to Dismiss which is set for hearing on March 11th.

Court Grants Sony's Temporary Restraining Order Against Geohot for jailbraking the ps3

The United States District Court of California has granted Sony's request for a Temporary Restraining Order and Order of Impoundment against Geohot over the PS3 jailbreak.

Having considered all the papers and arguments, the Court finds that SCEA has shown a likelihood of success on the merits of its claims for violation of the DMCA and CFAA, and that it will suffer irreparable harm unless Defeendant Hotz's violations are enjoined. The Court also finds that a Temporary Restraining Order and Order of Impoundment are necessary to prevent immediate and irreparable injury to SCEA before the hearing on the Order to Show Cause regarding the preliminary injunction can take place, and to preserve the status quo. The Court further finds that the balance of equity and interests of justice support granting such relief.

The Electronic Frontier Foundation recently addressed the matter. "That [Sony] can silence speech that reveals security flaws using the DMCA and that the mere fact of a terms of use somewhere gives a company permanent and total control over what you do with a device under pain of criminal punishment — are both sweeping and frightening". Its more than a little concerning that the United States Court is upholding Sony's actions.
